The terms "us", "we", "our", "NetVPX", or "Company" shall be used to describe NETVPX HOLDINGS LLC, of whom operates this website located at https://slurp.space/, all sub-domains, directories, and sub-directories thereof, and https://netvpx.com/, all sub-domains, directories and sub-directories thereof.
The "Services" shall refer to any product or service purchased or otherwise acquired from NetVPX.
The terms "you", "your", "client", or "customer" shall be used to describe solely you, the individual reading and accepting the Terms and Conditions hereof.
NetVPX reserves the right to refuse Services to any potential client and/or to deny renewal of Services to any existing client, at the sole discretion of NetVPX.
NetVPX’s Terms of Service and Acceptable Use Policy are both subject to change at any time. NetVPX will make reasonable efforts to notify current clients of any and all changes to these terms. A change in policy shall not be grounds for early contract termination or non-payment. Client recognizes that the nature of the service supplied and the initial rates and charges have been communicated to the client. The client is aware that rates may change based on availability of hardware or other factors. Clients will be notified of any increases in rates or charges prior to the billing renewal date on which such increases will take effect.
Severability and Indemnification
In the event that a court of competent jurisdiction finds any term or clause in this Agreement to be invalid, unenforceable, or illegal, the same will not have an impact on other terms or clauses in the Agreement or the entire Agreement. However, such a term or clause may be revised to the extent required according to the opinion of the court to render the Agreement enforceable or valid, and the rights and responsibilities of the parties shall be interpreted and enforced accordingly, so as to preserve their agreement and intent to the fullest possible extent.
Governing Law and Venue
These Terms of Service are governed and construed in accordance with the laws of the State of Colorado, without giving effect to any principles of conflicts of law AND WILL SPECIFICALLY NOT BE GOVERNED BY THE UNITED NATIONS CONVENTIONS ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS, IF OTHERWISE APPLICABLE. For any action at law or in equity relating to the arbitration provision of these Terms of Service or if you opt out of the agreement to arbitrate, you agree to resolve any dispute you haveith NetVPX exclusively in a state or federal court located in the State of Massachusetts, and to submit to the personal jurisdiction of the courts located in the State of Massachusetts, for the purpose of litigating all such disputes.
Refund & Dispute Policy
Slurp Space (which operates the domain “https://slurp.space”) is a service provided by NetVPX. Due to the intangible (virtual) nature of the goods and services provided by Slurp Space, they are not protected by any US-based physical item refund laws, and therefore all sales are considered final and non-refundable (except in special cases, such as fraud). Any and all attempted reversals or charge-backs will be disputed, and attempting these transactions on services provided by NetVPX will be considered a breach of these Terms. In the event of an attempted reversal or charge-back, NetVPX reserves the right to suspend, revoke, or deny access to all services provided by NetVPX, including Slurp Space. In the event of a fraudulent or suspected fraudulent reversal or charge-back, NetVPX shall have, in addition to all remedies of law, the right to an injunction to prevent further violation of these Terms and any other requirements listed herein. If you are banned, blocked or otherwise restricted from utilising or accessing Slurp Space, we reserve the right to revoke any and all services provided by Slurp Space, and shall offer no refund or reimbursement for any products or services purchased or otherwise obtained from Slurp Space. Slurp Space shall not, in any circumstance, be obligated to return any items or services upon the revocation of, decision to overturn, or expiration of any ban or other means of service denial.
